Google lets an administrator accept a business associate amendment in the Admin console. Only services on Google's HIPAA Included Functionality list are covered, and third-party apps and add-ons are not.
Microsoft says it offers a BAA to covered entities through its Online Services Data Protection Addendum, covering in-scope services such as Exchange Online. It also states that a BAA alone does not make you compliant.
Is Gmail HIPAA compliant for therapists?
Not by default. Google says customers without a signed BAA must not use protected health information in its services. With Google Workspace, an administrator accepts Google's business associate amendment, and only the services Google lists are covered. See Google's HIPAA guide.
Do I need a BAA for my email provider?
If the provider stores or transmits client information for you, HIPAA generally expects a business associate agreement. Read HHS guidance on BAAs and ask your vendor for theirs. This is general information, not legal advice.
Does a BAA make me HIPAA compliant?
No. Microsoft states it plainly: a BAA supports your compliance, but your practice still needs its own policies and safeguards.
